1. Notice
Tubotech Plumbing Products Philippines respects your privacy and will keep secure and confidential all personal information that you may provide to Tubotech when applying for a job with us. Tubotech complies with requirements pursuant to Republic Act 10173 or the Data Privacy Act of 2012. This notice describes how we process Candidate Personal Information, the types of information that we collect, for what purpose we use it, with whom we share it, and the choices you can make about our use of Candidate Personal Data. We also outline the measures that we take to protect the security of Candidate Personal Data and how you can contact us if you have concerns. Please read this Statement carefully to understand how we treat your Personal Data.
2. Definitions
- Candidate: For the purposes of this notice, the term Candidate includes current and former Tubotech employment applicants
- Personal Data: Any personal information being processed whether recorded or not relating to an identified individual that has applied for a job with Tubotech
- Consent: Any freely given, specific, informed indication of will, whereby the data subject agrees to the collection and processing of personal information about and/or relating to him or her. Consent shall be evidenced by electronic or other recorded means
- The Company or Tubotech: For the purpose of this notice, the Company or Tubotech refers to Tubotech Plumbing Products Philippines, its subsidiaries, and or affiliates.
3. Candidate Privacy Statement Principles
- Collect and manage the minimum amount of Personal Data to assess the Candidate’s employment application; and if an employment offer is extended and accepted, to facilitate the Candidate’s onboarding as a new employee;
- Respect individual privacy;
- Comply with Tubotech policies and relevant laws; and
- Follow appropriate standards and procedures when collecting and/or managing Personal Data.
4. What types of Candidate Personal Data Do We Collect?
Tubotech collects and manages the minimum amount of Personal Data in compliance with applicable legal requirements to assess the Candidate’s employment application; and if an employment offer is extended and accepted, to facilitate the Candidate’s onboarding as a new employee. The types of Personal Data that the Company may collect from or about you include, but are not limited to:
Data collected during the recruitment process before a decision is made on an application. This includes, for example:
- Contact information such as name, phone number, email address, region and municipality
- Professional and academic data such as your resume, education, qualifications and work history, including references
- Electronic identification data such as IP address, cookies, tags, and/or pixels
- Information collected during application-related tests, assessments, interviews and phone screenings.
- Data from background checks, such as reference checks, criminal records, and pre-employment medicals (where legally feasible)
- Information available publicly
- Information you choose to share voluntarily as part of the application process, such as marital status, age etc
- Any personal information required to be collected by law
Data collected after a Candidate accepts an employment offer, to facilitate the initial part of the onboarding process as a new hire. This includes for example:
- Personal characteristics such as gender, date of birth, marital status, place of birth and names of dependents
- Data required for legal and regulatory compliance, such as government identification and clearances
- Other financial account information (to set up payroll and benefits enrollment)
- Other medical or health information
5. For What Purpose and on What Legal Basis Do We Use Personal Data?
Tubotech may use Personal Data for the purpose of carrying out its application process, recruiting, staffing and new hire onboarding processes, including but not limited to the following activities:
- Assessing your skills, qualifications, and interests against Tubotech’s career opportunities
- Communicating with you about current and/or future career opportunities at Tubotech
- Verifying your eligibility for employment
- Upon acceptance of an employment offer, facilitating your onboarding as a new employee
- Continuously improving our recruitment processes
- Complying with applicable laws of the Philippines
6. How Do We Share Personal Data?
- Tubotech will only share Personal Data with those who have a legitimate business interest to know
- Tubotech may share your Personal Data with external parties who perform Tubotech business operations on our behalf
- There are certain situations where you will be asked to share personal information directly with service providers during recruitment processes or onboarding efforts, where Tubotech does not control how your data is processed e.g. external pre-employment medical examinations. In those situations, please ensure you read and understand the privacy policies and practices of such providers
- Personal Data may be shared with Tubotech’s Head Office in Australia as necessary to fulfill business-related purposes
- Tubotech may also disclose Personal Data if we are required to do so by law or legal process; to enforce or protect the rights and policies of Tubotech; to assist in the investigation of suspected or actual misconduct or illegal activity
7. What Are Your Privacy Rights?
Tubotech processes your Personal Data primarily based on your Consent. You may withdraw your consent to the processing of your Personal Data at any time during the recruitment process by emailing us at hrsup@tubotech.com. Note that once Consent is withdrawn, Tubotech may no longer consider you for employment.
8. How Do We Secure Candidate Personal Data?
Tubotech’s Candidate Personal Information Controller is the HR Supervisor. Tubotech implements reasonable and appropriate organizational, physical, and administrative measures to protect Candidate Personal Data against accidental or unlawful destruction, alteration, or disclosure, as well as against any other unlawful processing.
9. How Long Do We Keep Personal Data?
Once you have applied for a position, Tubotech will keep your Personal Data from the employment application on file for a maximum period of one (1) year. This is with the exception of those who are successful in gaining employment, as their Personal Data will be stored on their 201 files. Candidates may request that their data be deleted at any time within the one (1) year period. The request for deletion before the conclusion of the one (1) year period will generally be accepted unless the retention period is required by applicable law; and/or to fulfill Tubotech’s legitimate business interests, including, but not limited to our right to exercise or defend legal claims.
10. Further Modifications
Tubotech reserves the right to modify this notice at its discretion to reflect changes in law and or our internal standards. When we do so, we will notify you by posting the updated Statement on our website for your information and reference.
